The institutional design and ratification record are extensively documented. The score remains interpretive because it compares a newly created, exclusionary system with later constitutional practice.

Findings

  • The Constitution divided national power, created two chambers of Congress, provided for elections and amendments, and divided authority between federal and state governments.
  • The original system protected slavery and left most voting rules to the states, so only a narrow part of the public could participate.
  • The Bill of Rights was not part of the signed 1787 text. It was ratified in 1791.
